Please read these Terms of Service carefully before using our website or engaging our restoration services. These Terms govern your relationship with Rhino Flood & Water Damage Restoration Houston and set out your rights and obligations as a customer. 1. Acceptance of Terms

By accessing or using the website located at floodwaterdamagerestorationhouston.com ("Site") and by engaging Rhino Flood & Water Damage Restoration Houston ("Rhino," "we," "us," or "our") for any restoration services, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, customers, and others who access or use our Site or services.

If you do not agree to these Terms, you must immediately cease using our Site and not engage our services. We reserve the right to update these Terms at any time. Continued use of our Site or services after any changes constitutes your acceptance of the revised Terms.

2. Description of Services

Rhino Flood & Water Damage Restoration Houston provides professional water damage restoration, flood remediation, mold remediation, sewage cleanup, storm damage restoration, emergency water extraction, and related services (collectively, "Services") to residential and commercial customers in the Greater Houston, Texas area.

Service Area: Our services are primarily available within Harris County, Fort Bend County, Montgomery County, Galveston County, and surrounding areas. Availability may vary by location.

Emergency Services: We provide 24/7 emergency response. Response times may vary depending on crew availability, location, weather, and demand — particularly during widespread disaster events affecting multiple properties simultaneously.

No Guarantee of Specific Outcomes: While we are committed to delivering high-quality restoration work, we cannot guarantee specific outcomes such as the salvageability of particular materials, complete odor elimination in all cases, or the prevention of future damage from unrelated causes.

3. Estimates, Pricing, and Payment

Free Estimates: We offer free initial assessments and estimates. An estimate represents our professional judgment of the scope and cost of work based on visible conditions at the time of assessment. Final costs may differ from initial estimates if hidden damage is discovered, the scope of work expands, or additional services are required.

Authorization to Proceed: By authorizing us to begin work (verbally, in writing, or by allowing our crew to commence work), you agree to pay for all Services performed.

Insurance Work: If you are filing an insurance claim, you authorize us to communicate directly with your insurance carrier and adjuster. You remain financially responsible for any amounts not covered by your insurance, including your deductible, depreciation holdbacks, or any scope not approved by your insurer.

Payment Terms: Payment is due upon completion of Services unless otherwise agreed in writing. We accept major credit cards, check, and ACH transfer. Outstanding balances beyond 30 days may be subject to a 1.5% monthly late fee.

Supplements: In insurance work, if additional damage is discovered during the restoration process that was not included in the original estimate, we will document and submit a supplemental claim to your insurer. You authorize us to advocate on your behalf for fair coverage of all legitimate restoration costs.

4. Insurance Coordination

Assignment of Benefits: You may be asked to sign an Assignment of Benefits (AOB) form, which authorizes us to work directly with your insurer and receive payment directly for Services performed. This is common in the restoration industry and simplifies the claims process for you. Signing an AOB does not relieve you of responsibility for amounts not covered by your insurer.

No Guarantee of Coverage: We cannot guarantee that your insurance carrier will approve all or any portion of a claim. We will advocate for your interests, but final coverage decisions rest with your insurer.

Policy Compliance: You are responsible for understanding the terms of your own insurance policy, including deductibles, coverage limits, exclusions, and filing deadlines. We will assist where we can but are not insurance advisors.

5. Property Access and Customer Responsibilities

Access: You agree to provide our crew with safe, unobstructed access to all affected areas of your property during the restoration process. You or an authorized representative must be available or reachable during the assessment and at key project milestones.

Hazard Disclosure: You agree to inform us of any known hazards on your property, including but not limited to asbestos, lead paint, mold of unusual toxicity, structural instability, biological hazards, or the presence of dangerous animals.

Utilities: You are responsible for ensuring that utilities (water, electricity) are available to the property during restoration work unless otherwise arranged. If utilities must be shut off for safety during certain phases, we will coordinate this with you.

Personal Property: Please remove or secure valuables, irreplaceable items, and pets before our crew arrives. While we take care working around your belongings, we are not liable for pre-existing damage or damage to items not disclosed as fragile or valuable.

Structural Decisions: Any decision to demolish, remove, or modify structural elements of your property will be discussed with you before work begins, except in emergency situations where immediate action is necessary to prevent further damage.

6. Workmanship Warranty

Rhino Flood & Water Damage Restoration Houston warrants that all restoration work performed by our employees will be completed in a professional and workmanlike manner consistent with industry standards.

Warranty Period: Our workmanship warranty covers defects in our work for a period of one (1) year from the date of project completion.

Exclusions: This warranty does not cover damage caused by subsequent water intrusion events, natural disasters, acts of God, improper maintenance by the customer, or work performed by third parties after our completion.

Warranty Claims: To make a warranty claim, contact us in writing within the warranty period describing the alleged defect. We will inspect the work and, if covered, repair or redo the defective work at no additional charge.

No Other Warranties: Except as stated above, we disclaim all other warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by Texas law.

7. Limitation of Liability

Maximum Liability: To the fullest extent permitted by applicable law, Rhino Flood & Water Damage Restoration Houston's total liability to you for any claims arising out of or related to our Services shall not exceed the total amount you paid us for the specific Services giving rise to the claim.

Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, loss of profits, or loss of data, even if we have been advised of the possibility of such damages.

Force Majeure: We shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, severe weather events, supply chain disruptions, government actions, or public emergencies.

Pre-Existing Conditions: We are not responsible for pre-existing damage, latent defects, or conditions that were not visible or discoverable during our assessment.

8. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Jurisdiction: Any legal action or proceeding arising out of or related to these Terms or our Services shall be brought exclusively in the state or federal courts located in Harris County, Texas. You consent to personal jurisdiction in such courts.

Waiver of Jury Trial: Both parties waive the right to a jury trial in any dispute arising from these Terms or our Services, to the extent permitted by law.

9. Website Use and Intellectual Property

Permitted Use: You may use our Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from any content on our Site without our express written permission.
